If AC has a trademark on "Soft Wash Systems", how are the guys at Ugly Shingles able to market a similar business with a similar product?

Barry I moved this thread to ON THE SIDE. I think AC has SOFT-WASH word marked or trade marked and I don't think he cares very much about the Ugly's. He is way above them.

So I understand this clearly, the word "softwash" is trademarked. Does this mean any use of the word softwash written as one work is illegal whether used as a noun or adjective?

This will be interesting. All the members here and on other forums who are trying to push education of the softwash process. will be in fact helping to market and advertise for a business other than there own . . .

I'm not really worried about anything personally....I've had the phrase on one of my sites since 2007. I did do a TESS search and found several entries under "softwash" but none were registered to AC.
Again, not trying to stir up a hornets nest but since I do web design and other internet services related to this industry, I come across the phrase almost daily either in a domain name or in content.

This is another concern...The phrase has been pushed into common use (general public) by hundreds, maybe thousands of people in the industry for over a decade. It's a fair use issue IMHO.

Brilliant marketing tactic by the other guy!
I like the position taken by many on here that what we do-- roof and exterior cleaning plus plus plus, and how we do can be defined easier when softwash is used properly.
I have begun to tag our posts with what the public is looking for, such as housewashing, pressure washing, roof cleaning etc etc and in the process of talking with our customers after they visit our site www.PAsoftwash.com and understand what softwashing is, they are asking for non pressure-- ie softwash processes by choice.

Please feel free to use the term softwash or soft wash or Soft Wash or soft wash systems. I only claim "SoftWash Systems" any other use of the words or combination of the words is GOOOOOOOOOOD for all.

Soft wash could be the new key words? Ron and Henry talked against it. Pressure washing was the main one. "as long as pressure washers are in home depot" I think Ron said that
Some guys are "rebranding", I thought about it too. Talked to Laura, and we agree stay with GutterDogs. Going back with her. She is alot smarter now!

Cover all the bases. Own Google key words soft washing. Make your customers smarter. Dont search pressure washing. Search soft washing. soft washing, soft washing put that in your customers head. Easy to do. Soft washing is better!

Glad to hear that AC...I was pretty sure the concern and worry from some of the old discussions was mostly paranoia and speculation.
It really does work in your favor for the phrase to move to common use.
Description of Mark: "The mark consists of the word Softwash surrounded by a single-line amoeba-like shape with shading on lower side of the shape."
Basically, as long as you are not using that logo or a close variation....you are ok
