the moronic lowball hack I've talked about before on this forum has stolen photos from my website and is using it on his website! It's the gray roof that features prominently on my website and on the tailgates of all of my company vehicles. It's not a job he's done, it's literally my exact photo stolen from my website!
Now, what to do about it? Was considering a lawyer cease-and-desist letter, but I think I'm going to go the route of contacting his website host , which is wix, and try to get his site brought down, before I send a letter to him. What are your thoughts?
This past winter I had to deal with a knucklehead up this way whom used my promo posts photos as his own. In addition he used Danny Cronouer's photos as well. I beat him to death with repetitive messages on facebook, voicemail and google+. Initially, he was not a happy camper and even cursed me out in a facebook and google+ messge. He gave in when I told him I was contacting his web company. He gave in and asked if we could bury the hatchett . My replay was yes I would love to bury my hatchett in your head.
I guess I was showing my horns. It happens once in a while.

I see this two ways.
#1. If he is just a hack type; I would not warn him at all. I would go straight to the hosting company and ask for the site to come down. I think you have enough evidence to get it done. They would probably call him and ask him to voluntarily remove it though.
If you have a lawyer you work with then do the letter after, and in conjunction with, the phone call to the hosting company.
This shows him you ain't play'en.
#2. If he is a guy that really is trying then maybe a phone call (I think this one isn't the one based on what you've posted in the past).
A "friendly" phone call could help shape a relationship. The problem there is that he is in the same area and competing for the same jobs. I like to help people but don't like to take food from my kids.
Now the bigger problem. His name is Ray and his logo is a large water droplet and his website has your image.........

Lots of things going on with this guy. Your Pic's, Our Ray Capital's Company name and his name is Ray. Plus you guys all work in the same city. It all adds up to making the consumer more confused with who they are hiring.

Copyright law is interesting. You certainly own the pictures but without a registered copyright, any atty who doesn't want to steal your money will tell you there is little you can do. I am trying to remember to water mark all my new photos. It sucks that we have to do that. I just wish I could remember to watermark everything. Download Fastone, there is a watermark tool there.

I've talked to two different attorneys today, was told "I will win", but shoot for a settlement, as it has to be tried in federal court and that is expensive.

Ray, So glad to know you have that! The question is... does he have/own anything? It might be a worthless win after paying those expensive atty's. I would feel just as you do and want to kick some serious butt.

Its funny and flattering that he hasnt done any work good enough to use his own pictures. Ive seen where some of pictures have the companys name made to them I guess that would stop that if put in the right spot. I seen a post from some one that said if you steal there pics they will contact your hosting company have your site locked down until they have taken there sweet time to comb through your site and make sure that all info is down.
