 OHHHHHHh NO NO NO........I was in no way suggesting you do a domain swap or cow town to this guy.
I'm saying that I would go after him to give up the domain name to me and to do it now. I would be telling him "Every single day the blank page is up I will hold you financially responsible" 

He has already admitted to deceiving the public. He has no leg to stand on and he should relinquish the domain to prevent further damage to your company. If he wants the other domain let him have it for.....say....$150,000 and a date with your neighbors dog (why punish your own dog).
